01Agreement

These Terms & Conditions govern your use of the Evergreen Points website (the "Site"), operated by Evergreen Points Pty Ltd. By opening or browsing the Site, you agree to be bound by them in full.

If you don't accept these terms, please don't use the Site. We may revise them, so it's worth a glance now and then — continued use after a change means you accept the updated version.

02Travel disclaimer

Evergreen Points is an independent editorial publication. We offer opinions, descriptions and recommendations about hotels and destinations for general interest and inspiration only. We are not a travel agent, tour operator or booking service, and we neither sell nor arrange accommodation.

Prices, availability, facilities, hours and ownership change without warning. You are responsible for confirming every detail directly with the relevant hotel or provider before you commit, and any contract you make is strictly between you and that provider.

03Fair use

You agree to use the Site lawfully and in a way that never impairs anyone else's use of it. In particular, you must not:

• Seek unauthorised access to the Site, its servers or connected systems;
• Introduce viruses, malware or other harmful code;
• Copy, scrape or harvest content for commercial purposes without our written consent;
• Use the Site in any manner that could damage, disable or overburden it.

We may limit or withdraw access to the Site, wholly or in part, at any time and without notice.

04Accuracy

We take real care to keep the guide accurate and current, and we revisit stays regularly. Even so, the Site is provided on an "as is" and "as available" basis, and we make no warranty as to the completeness, reliability or fitness of the content for any purpose.

Any reliance you place on what you read here is at your own risk. Opinions are our editors' own and are not professional, financial or legal advice.

05Intellectual property

All content on the Site — text, layout, graphics, decorative elements, the "Evergreen Points" name and logo — is owned by or licensed to Evergreen Points Pty Ltd and protected by Australian and international law.

You may view and print content for personal, non-commercial use. Any other use — reproduction, modification, distribution or republication — needs our prior written permission.

06Outside links

The Site may link to external websites run by hotels, partners or others, offered purely for convenience. We don't control or endorse those sites and take no responsibility for their content, products or practices; you follow them at your own risk.

07Liability

To the fullest extent the law allows, Evergreen Points Pty Ltd, its directors, staff and contributors are not liable for any direct, indirect, incidental, consequential or special loss arising from your use of, or inability to use, the Site or anything on it.

Nothing here excludes or limits any guarantee, right or remedy under the Australian Consumer Law that cannot lawfully be excluded. Where our liability can be limited but not excluded, it is limited to re-supplying the relevant information.

08Governing law

These Terms & Conditions are governed by the laws of New South Wales, Australia. You submit to the exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia for any dispute connected with the Site or these terms.

We may amend these terms at any time by publishing a new version here; the date at the top shows when the current terms took effect.
